U.S. State Privacy Rights
This section is intended to provide a nationwide framework for privacy rights that may be available to residents of the United States. Privacy laws differ by state, may apply only when statutory thresholds are met, and may change over time. Where an applicable federal, state, or local privacy law provides you with rights or protections that differ from or exceed those described in this Policy, Kabot Advisors will honor those rights and protections to the extent required by applicable law.
Privacy Rights That May Apply
Depending on your state of residence and the applicability of the relevant law, you may have the right to: confirm whether we process your personal information; access personal information we maintain about you; correct inaccuracies; request deletion; obtain a portable copy of certain personal information; opt out of the sale of personal information; opt out of sharing or processing for targeted or cross-context behavioral advertising; opt out of certain profiling or automated decision-making that produces legal or similarly significant effects; limit or withdraw consent for certain processing of sensitive personal information; and appeal a decision we make regarding a privacy request. You may also have the right not to receive discriminatory treatment for exercising applicable privacy rights.
Categories of Information, Sources, Purposes and Disclosures
Depending on how you interact with the Site, we may collect identifiers and contact information; professional, employment and business information; communications and information you submit; internet, device and network activity; approximate location inferred from an IP address; and other information you voluntarily provide. We may collect this information directly from you, automatically through your use of the Site, from service providers, business partners and publicly available sources. We may use it to provide and improve the Site and our services, respond to inquiries, manage business relationships, perform analytics, maintain security, prevent fraud, comply with legal obligations, market our services where permitted, and conduct other purposes disclosed at or before collection.
We may disclose personal information to service providers and contractors that perform functions on our behalf; professional advisers; affiliates; business partners where appropriate and permitted; governmental authorities or other parties when required by law or necessary to protect rights, safety or security; and parties involved in a merger, acquisition, financing, reorganization or sale of all or part of our business. Kabot Advisors does not sell personal information for monetary consideration. If our practices constitute a “sale,” “sharing,” or targeted advertising under an applicable state law, we will provide the opt-out mechanisms required by that law.
Sensitive Personal Information
Kabot Advisors does not seek to collect sensitive personal information through the Site unless it is reasonably necessary for a disclosed business purpose or you voluntarily provide it. Where applicable law requires consent before processing sensitive personal information, or provides a right to limit or opt out of such processing, Kabot Advisors will comply with those requirements.
Exercising Your Privacy Rights
You may submit a privacy request by contacting Kabot Advisors through the Contact page on this Site. Please identify the state in which you reside, the right you wish to exercise, and sufficient information for us to reasonably verify your identity and locate relevant records. We will use information provided in connection with a request only as reasonably necessary to verify and fulfill the request. We may deny or limit a request where permitted by law, including when we cannot reasonably verify the requester, an exemption applies, or retention is required or permitted by law.
Where applicable law permits an authorized agent to submit a request for you, we may require evidence of the agent’s authority and may ask you to verify your identity directly. If applicable law gives you a right to appeal our decision, you may submit an appeal through the same Contact page and clearly label the request “Privacy Appeal.” We will respond within the period required by applicable law.
Universal Opt-Out Signals
Where required by applicable law, Kabot Advisors will recognize legally valid universal opt-out preference signals for covered processing, such as qualifying browser-based opt-out signals. A browser’s general “Do Not Track” setting is distinct from a legally recognized universal opt-out mechanism and may not have the same legal effect.
Data Minimization, Retention and Security
We seek to collect personal information that is reasonably necessary and proportionate for the purposes described in this Policy and to retain it only for as long as reasonably necessary for those purposes, subject to legal, accounting, security and contractual requirements. We use reasonable administrative, technical and organizational safeguards designed to protect personal information, but no method of transmission or storage can be guaranteed to be completely secure.
State-Specific and Other Privacy Laws
This nationwide notice supplements, and does not limit, any rights available under state-specific privacy, data security, breach-notification, biometric, health-data, communications, marketing, data-broker, children’s privacy or other laws that apply to Kabot Advisors or to a particular processing activity. Not every state has enacted a comprehensive consumer privacy statute, and not every privacy statute applies to every business or processing activity. Kabot Advisors will apply the requirements of applicable law based on the circumstances.
Supplemental Notice to California Residents
Effective Date: January 1, 2020; updated and supplemented November 1, 2026
If you are a California resident, California law may apply to how we collect and use your personal information, and what rights you have in some circumstances. The following terms supplement our Privacy Policy and explain the rights of California residents.
For information about what categories of personal information we may collect from our customers, the sources of that information, the purposes for collecting and using that information, and what types of third-party service providers we may share that information with, please see our section discussing personal information collected.
California residents have the following rights:
· The right to request information about personal information that we have collected about that customer in the 12 months preceding the customer’s request (including the categories of information collected, the source of that information, the business purpose of that collection, the categories of third parties with whom that information is shared, and the specific pieces of personal information collected about that particular customer);
· The right to receive requested information in a readily-usable format if provided electronically;
· The right to request that we delete any personal information about the consumer that we have collected (although we may be entitled to retain some information for certain purposes);
· The right to opt-out of “sales” of personal information to third parties, if applicable; and
· The right to freely exercise your rights without being denied goods or services.
We cannot respond to your request to access or delete information unless we are able to both verify your identity or authority to make the request and confirm the personal information relates to you and/or your household. If you have an account on any of our Sites and Apps, we will verify your identity by having you log in to your account. If you do not have an account on our Sites and Apps, we will attempt to verify your request by asking you to provide identifying information that we will match to information in our files. We will only use information you provide in your request for the purpose of verifying your identity or authority to make the request. You can also designate an authorized agent to make a request on your behalf. Your agent will need to provide a Power of Attorney authorizing the agent to act on your behalf, or will need to complete the same verification procedures that would be required for a request submitted by you directly, and provide information that allows us to verify your authorization.
We may deny deletion requests in whole or in part as permitted or required by applicable law. We do not charge a different price or rate or provide a different level or quality of goods or services based on your exercising your CCPA rights. We do not sell personal information.
